1.)Breeder and Buyer agree that the above described puppy is a purebred Toy/Miniature Australian Shepherd and is being sold as pet companion with limited registration and no breeding rights.
2.)Puppy will be registered with the American Stock Dog Registry by the breeder and mailed directly to the owner. A copy of the applications will be included in your welcome folder.
3.)The breeder guarantees that the puppy is in good health, free of communicable diseases and sound temperament. Puppy has received its first set of 5 way vaccinations and has been dewormed three times since birth. Health records will be furnished at time of the signing of this contract.
4.)Buyer agrees to activate the microchip with their information within 7 days and to activate the 30 day Free Trupanion Pet Insurance within 24 hours of pickup. Failure to do so will result in the contract being null and void.
5.)The buyer agrees that the puppy shall be examined by a reputable veterinarian within 72 business hours of receiving the puppy or this contract will be considered null and void. If puppy does not meet a general health exam, Buyer agrees to notify the Breeder within 72 business hours and provide a written statement of health as such from a licensed veterinarian. Minor, treatable problems such as diarrhea, coccidiosis, giardia, worms and parasites etc. are common problems in puppies and will not be covered by this warranty although every effort is made to prevent this.
6.)Your puppy is due for a 10, 13 and 16 week vaccinations and rabies vaccination at 4-6 months. All other vaccinations are at the buyers discretion. Your puppy is due to start on heartworm preventative no later than 4 months of age. Additionally, we recommend flea and tick prevention be started by four months of age. Buyer agrees to follow the regular vaccine, deworming, heartworm, flea and tick prevention schedule for the life of the puppy. Failure to do so will result in this contract being null and void.
7.)The Breeder is not responsible if the puppy contracts a communicable disease after 72 hours from when the puppy leaves the possession of the Breeder.
8.)If puppy is found to be at risk for a genetic defect within 12 months of the date of birth Buyer will provide verification in writing by a licensed veterinarian. Orthopedic issues such as but not limited to patella's, knees and hips will be addressed on a case by case basis as the Breeder has no control over the environmental factors that can affect said issues.
9.)Breeder is making the buyer aware that they should refrain from allowing/teaching their puppy to jump off the couch, for a frisbee, a ball, in agility situations, and on hard surfaces until they reach maturity around 18 months old.
10.)In the event that the puppy does not meet a general health exam or is found to have a genetic defect as stated above in #2 and #3 the Breeder will then replace the puppy with one of the same sex and coat color from the first available litter. The original puppy as described above shall be returned to the Breeder at the Buyers' expense. If the Buyer decides to keep the puppy, the puppy must be neutered or spayed at the Buyers expense and the Buyer will have the option to purchase another puppy of their choice at 50% of listed price. Under no circumstances will money be refunded. Additionally, the Breeder will not be responsible or obligated to pay any veterinary expenses at anytime.
11.)Buyer agrees that they have researched the breed and understands that Aussies are an active and intelligent herding breed. Therefore they require adequate exercise, socialization and training. Buyer also further understands that they have a natural instinct to herd and that they will go thru a chewing/mouthing/ nipping period. Puppy is warrantied only for the purpose of being a pet/companion not for show or breeding.
12.)Breeder requires that the Buyer attend obedience, clicker or similar training classes with the puppy and provide proper socialization opportunities for the puppy. Breeder further recommends that Buyer crate train puppy, provide adequate exercise opportunities and requires that puppy not be regulated to a life outside, in a kennel or on a chain.
13.)Breeder requires that the Buyer spay or neuter said puppy by one year of age providing veterinary paperwork of proof to the breeder.
14.)Breeder cannot guarantee adult size, conformation or temperament of the puppy. Buyer hereby releases breeder and agrees to hold harmless for any liability, injuries or damages to persons or property caused by this puppy. Buyer shall assume full responsibility for the health, temperament and appearance of the puppy upon taking possession of said puppy.
15.)It is the Breeders sincere intention that none of our puppies are ever taken to a shelter. If at any point in the future, the Buyer cannot keep the puppy, the breeder will assist with rehoming puppies that have been kept current on vaccaintions, heartworm medications and flea and tick as well as has had training. If you are placing due to experiencing training/behavioral issues, I recommend you seek out a trainer before placing the dog.
16 .)The Breeder agrees to provide the Buyer with the puppy's health records, a sample bag of puppy food, written instructions for feeding, training and resource information that will assist the Buyer in raising a happy, healthy Aussie.
The Buyer has read and understands the foregoing and agrees that all parts constitute a binding agreement with the Breeder. The undersigned agree to uphold all covenants of this agreement. In the event of litigation, the venue shall be Montgomery County, Indiana.
